PRIVATE MENTORING AGREEMENT
For the Book Blueprint Programs
MENTORING PERIOD AND PACKAGE INCLUSIONS
Private Mentoring runs concurrently with your enrolled group intensive and includes:
Full access to all live group sessions and provided materials within your enrolled intensive (Book Contract Blueprint (“BCB”) OR Book Platform Blueprint (“BPB”))
Weekly 30-minute private implementation sessions with Emma Churchman, held each week of your intensive (5 sessions for BCB; 6 sessions for BPB)
AGREEMENT
This agreement between you and Emma M. Churchman LLC is a binding contract and applies to your participation in the program identified above. This contract is governed by North Carolina state law, and the jurisdiction is Henderson County. Each party expressly consents to the jurisdiction of the State of North Carolina should litigation arise between the parties.
By signing below, you acknowledge that you have read, agree to, and accept all of the terms and conditions contained in this Agreement. Modifications to this Agreement must be submitted in writing and require the agreement of all parties.
I understand that as my mentor and coach, Emma Churchman will be totally focused, present, and creative during all mentoring sessions and she will not hold anything back, even when things come up that are challenging to talk about. Emma will continually hold my vision, remain on the lookout for places where I have a blind spot, help keep me focused on my goals and outcome, and always communicate to me with respect and with Truth. She will help me raise the bar, grow into my choices, and help me discover patterns that are not serving me and release them. I agree to be coached in this way by Emma.
I agree to be 100% responsible for the results I get during this program and to follow a NO excuse policy. I agree to show up on time with no distractions, to give 100% before, during, and after the program, and to take 100% responsibility for actions in my business and success or lack of success with mindset. I agree to show up prepared to be coached and to share with Emma anything that may be influencing me or my business. I commit to always remaining open and honest with Emma, and to be in action and be coachable, in terms of trying new things and seeing my blindspots. I take responsibility for completing the actions agreed to and setting goals for each session.
I understand that there can be no assurance that any prior successes, or past results in income earnings from other clients or Emma herself, can be used as an indication of my future success or results. I acknowledge monetary and income results are based on many factors. Emma M. Churchman LLC does not guarantee or imply that I will get rich, that I will do as well, or that I will make any money at all, especially if I do not do the work that’s asked of me or I ignore any other advice presented to me. I agree that I am solely responsible for doing my own due diligence when it comes to making business decisions and all information that has been provided should be independently verified by my own qualified professionals including checking with my accountant, lawyer, or professional advisor, before acting on this or any information. I agree that Emma M. Churchman LLC is not responsible for the success or failure of my business decisions relating to any information presented by Emma, by her team, or by any of her products or services.
To not distribute the program materials
To hold my coaching fees in confidence
To provide twenty-four (24) hours notice to reschedule private coaching sessions, and that barring an unexpected emergency, missed sessions cannot be rescheduled.
PAYMENT & FINANCIAL RESPONSIBILITY
I authorize Emma M. Churchman LLC to accept the Payment above as payment for the Program I am enrolling in. Furthermore, I agree I am responsible for the full payment, regardless of whether I fully complete the Program, and regardless of the results I achieve as part of this Program. To further clarify, no refunds will be issued during or after the program.
If a payment plan is selected, payments are to be made on time, without exception. It is my responsibility to ensure all payments are made as scheduled. If I am unable to make a payment on time, I must proactively contact support@emmachurchman.com at least four (4) days prior to the due date. An extension may be approved by the team if notified in advance; this extension is exactly seven (7) days from the original payment due date and may only be granted one (1) time during any payment plan.
If a payment is missed or late beyond the approved extension period, I understand that I will be removed from the program and forfeit all program benefits. I will have seven (7) days from the extended payment due date to bring my account to current status. Failure to do so will result in removal from Emma’s community, including all active Facebook groups, and I will be blocked from participating in any future programs. Additionally, I will incur an additional $100.00 fee every 7 days for missed payments beginning on day 7. All payment inquiries should be directed to support@emmachurchman.com.
CONFIDENTIALITY
Emma M. Churchman agrees not to disclose, reveal, or make use of any Confidential Information learned through our sessions or transactions, without my written consent. Emma shall keep my information in strict confidence and use her best efforts to safeguard it against disclosure, misuse, loss, or theft.
I agree to hold my coaching fees in confidence and not to distribute any program materials provided as part of this program.
SESSION TERMS & SCHEDULING
I agree to provide twenty-four (24) hours’ notice to reschedule a private session. Barring an unexpected emergency, missed sessions cannot be rescheduled. Barring unforeseen technical difficulties, Emma will provide me with a recording of each session at my request.
Emma has my permission to: acknowledge me publicly as her client; use me as a reference; and record our sessions. At any time, I may request that a session not be recorded.
COACHING RELATIONSHIP & RESPONSIBILITIES
I understand that as my mentor and coach, Emma Churchman will be fully present and engaged during all private sessions and will not hold anything back, even when challenging topics arise. Emma will hold my vision, help keep me focused on my goals, and communicate with respect and honesty.
I agree to be 100% responsible for the results I achieve during this program. I will show up on time, free of distractions, and give full effort before, during, and after each session. I commit to being open and honest, remaining coachable, and taking responsibility for completing the actions I agree to in each session.
I understand that Emma is not a licensed therapist, legal advisor, or financial advisor, and that I am solely responsible for my thoughts, feelings, actions, and business decisions. I will seek independent professional advice (legal, financial, or otherwise) as needed.
FORCE MAJEURE
Emma M. Churchman LLC shall not be deemed to be in default of its obligations hereunder if and so long as it is prevented from performing such obligations as a result of events beyond its reasonable control, including without limitation, fire, power failures, any act of war, hostile foreign action, nuclear explosion, riot, strikes or failures or refusals to perform under subcontracts, civil insurrection, earthquake, hurricane, tornado, pandemic, or other catastrophic natural event or act of God.
If the force majeure affects the performance of the contract, Emma M. Churchman LLC will notify the client and submit a sufficient and valid proof of force majeure within a reasonable period. The contract will resume within a reasonable period, once means to resume the contract are available (eg. stable power, internet, and cell phone service). The only reason the contract will be terminated following force majeure is if services cannot be resumed within a reasonable period of time, once means to resume are available.
EARNINGS DISCLAIMER
There can be no assurance that prior successes or results of other clients can be used as an indication of my future success. Emma M. Churchman LLC does not guarantee any specific income results. I acknowledge that outcomes depend on many factors including my own effort, background, and market conditions. I agree that Emma M. Churchman LLC is not responsible for the success or failure of my business decisions.
INDEMNIFICATION
I shall defend, indemnify, and hold harmless Emma M. Churchman, Emma M. Churchman LLC, and her employees, directors, independent contractors, related entities, trustees, affiliates, and successors from and against any and all liabilities and expenses whatsoever - including without limitation, claims, damages, judgments, awards, settlements, investigations, costs, attorney’s fees, and disbursements - which any of them may incur or become obligated to pay arising out of or resulting from advice given during this coaching engagement, excluding any such expenses and liabilities which may result from a breach of this Agreement or sole negligence or willful misconduct by Emma M. Churchman or any of her affiliates or successors.
A breach of this Agreement is defined as: failure to deliver the package inclusions within the program dates of the enrolled intensive.
